Out of Hours Express Ltd. shall not be liable for any indirect, consequential, or incidental losses arising from the loss, damage, or delay of goods, including but not limited to loss of profits, business interruption, or any other financial loss, whether or not such losses were foreseeable.
2.3 Insurance and Coverage
We are not liable for any loss or damage to goods that have not been booked and paid for with insurance prior to collection. In order for us to accept responsibility for any loss or damage, insurance must be purchased and confirmed before collection. If no insurance is arranged, you agree that we bear no liability for any loss or damage.
2.4 Force Majeure
We will not be liable for any failure or delay in the performance of our services due to events beyond our control, including, but not limited to, natural disasters, strikes, lockouts, government actions, and other events of force majeure.
2.5 Indemnity
You agree to indemnify and hold harmless Out of Hours Express Ltd., its employees, agents, and subcontractors from any claims, damages, or expenses arising out of or related to your use of our services, including but not limited to any legal costs, fines, or penalties incurred due to inaccurate or incomplete information provided by you.
3. Booking and Payment
3.1 Booking Confirmation
Bookings are considered final once confirmed by us, either via email, phone, or any other method of communication. No bookings are valid until confirmation is provided.
3.2 Payment Terms
All charges for services must be paid in full prior to the dispatch of goods, unless otherwise agreed upon in writing. Payments are non-refundable, except as required by law. By making a payment, you agree to adhere to the terms outlined in these Terms and Conditions of Carriage.
3.3 Non-payment
We reserve the right to suspend or cancel services if payment is not received in full. Additionally, any outstanding fees or costs incurred due to non-payment will be the responsibility of the customer.
4. Delivery and Transit

Estimated delivery times are provided for guidance purposes only. Out of Hours Express Ltd. does not guarantee specific delivery times and will not be liable for delays.
4.2 Damage or Loss
Claims for damaged or lost items must be submitted in writing within 48 hours of delivery, or within the period required by law. We will assess claims on a case-by-case basis and may request proof of damage or loss. For items without insurance coverage, no claims for loss or damage will be accepted.
5. Customer Responsibilities
5.1 Accurate Information
You are responsible for providing accurate and complete details when booking services. We are not responsible for any delays, damages, or errors that occur due to incorrect or incomplete information.
5.2 Packaging Requirements
It is your responsibility to ensure that goods are adequately packed for transit. Out of Hours Express Ltd. is not liable for damage to improperly packed items.
6. Termination and Suspension of Services

We reserve the right to suspend or terminate our services without notice if we believe that you have violated any of these Terms and Conditions or if payment has not been made.
6.2 Right to Refuse Service
Out of Hours Express Ltd. reserves the right to refuse service to any individual or entity for any reason, including but not limited to improper or dangerous goods, suspicious activity, or any violation of these Terms.
